The Federal High Court in Abuja has halted proceedings in the suit filed by Nafiu Bala challenging the leadership of the African Democratic Congress (ADC), pending a decisive ruling by the Supreme Court on an appeal brought by former Senate President David Mark.
Justice Emeka Nwite ordered an indefinite adjournment (sine die) of the case after confirming that a crucial appeal concerning the court’s jurisdiction is already before the apex court. The judge stressed that continuing with the matter while the Supreme Court is seized of the issue would be legally inappropriate and could render any outcome invalid.
The suit, instituted by Bala, contests the emergence of David Mark as national chairman and Rauf Aregbesola as national secretary of the ADC. Bala argues that their appointments violated the party’s constitution and is seeking to nullify their positions, as well as restrain them from acting as party leaders.
During proceedings, Bala’s counsel informed the court that the matter was already before the Supreme Court, urging a suspension of the trial. Justice Nwite agreed, emphasizing that jurisdiction is fundamental to any legal process and that proceeding without clarity on it would amount to a nullity under the law.
The development follows an ongoing legal tussle that has escalated through multiple courts. David Mark had earlier challenged the Federal High Court’s authority to hear the case, arguing that the dispute falls within the internal affairs of a political party—an area typically outside judicial intervention.
Although the Court of Appeal dismissed Mark’s earlier objection and directed parties to maintain the status quo, the matter has now progressed to the Supreme Court, which has fixed a date to hear the appeal. The apex court’s decision is expected to determine whether the lower court can proceed with Bala’s claims.
Legal analysts note that the Federal High Court’s decision effectively pauses the substantive dispute, placing the burden of resolution squarely on the Supreme Court. Until then, the leadership crisis within the ADC remains unresolved, with both factions awaiting judicial clarity on the legitimacy of the party’s national leadership.
