No Court Can Compel Two Persons to Marry, NBA Declares

Posted on October 22, 2025October 22, 2025 By Rextun boss No Comments on No Court Can Compel Two Persons to Marry, NBA Declares

In a strongly worded response to a recent judicial directive, the Nigerian Bar Association (NBA) has declared that no court in Nigeria has the constitutional power to compel two individuals to marry, emphasising that such an order would violate fundamental human rights.

The controversy stems from a widely reported alleged order by a magistrate court in Kano State asking two popular TikTok content creators, Idris Mai Wushirya and Basira Yar Guda, to get married within 60 days.

The directive reportedly followed their arraignment for producing and circulating a video deemed “indecent” by authorities in the state.

According to media reports, the court, presided over by a magistrate (identified in some sources as Halima Wali), ordered the pair to formalise their relationship and directed the state’s Hisbah (morality enforcement body) to arrange for the marriage.

The controversial verdict has stirred widespread debate across social media and traditional channels, with questions raised about judicial overreach, personal liberty and the interface between traditional morality and modern legal norms.

In its public statement, the NBA made clear that the directive is incompatible with the rights enshrined in Nigeria’s Constitution. The association pointed out that:

Marriage is a voluntary union between consenting adults, and cannot be imposed as a remedy for moral or social concerns.

No Nigerian court has the authority to compel two persons to marry. To attempt such is unlawful.

The order infringes on the rights to personal liberty, dignity of the human person, and privacy guaranteed under the 1999 Constitution (as amended).

Such judicial directions risk undermining public confidence in the justice system and blur the line between moral enforcement and legal adjudication.

The NBA called on the relevant judicial authorities in Kano State to review the decision and ensure that future orders align with constitutional safeguards rather than veer into enforcement of social compliance.

This episode raises profound questions for Nigeria’s legal system and society at large:

  1. Separation of moral regulation and legal coercion: While states like Kano, operating under both civil and Sharia-influenced systems, may have mechanisms for regulating public morality, using them to mandate marriage crosses into the territory of coercion.
  2. Judicial boundaries and due process: A court order compelling marriage appears to lack a basis in statute or precedent and may set a worrying precedent for other forms of compelled social regulation.
  3. Digital era exposure and social media culture: The crisis reflects tensions between youth-driven online content creation (for platforms like TikTok) and conservative morality enforcement in certain Nigerian states. As one report observed, the viral nature of the duo’s videos triggered the intervention.
  4. Human rights and consent: Central to the NBA’s objection is consent, perhaps the most essential element in marriage. Any order lacking voluntary agreement brings into question the legitimacy of the union and the protections afforded to both parties.
  5. Public trust in courts: If courts become instruments for enforcing morality rather than adjudicating rights, they risk losing credibility as guardians of justice.

While it remains unclear how the parties will respond to the directive, the NBA’s intervention signals the potential for legal challenge. Should the case proceed without reconsideration, it could be appealed on grounds of constitutional breach, especially given the NBA’s preparedness to monitor the matter through its Citizens’ Liberties Committee and Women’s Forum.

For content creators and citizens alike, the episode serves as a reminder of the evolving risks in Nigeria’s digital-public-morality space. As social media participation grows, so too does scrutiny from traditional moral guardians, raising new legal quandaries.

The NBA’s message resonates clearly: no court in Nigeria may compel two individuals to marry. Such an order sits outside the remit of judicial authority, conflicts with fundamental rights under the Constitution, and raises deep concerns about the direction of moral regulation in Nigeria.

As this story unfolds, it underscores the need for clarity in the law, protection of personal autonomy, and vigilance against judicial actions that undermine liberty in the name of social norms.
