The Federal High Court in Abuja has discharged and acquitted suspended Deputy Commissioner of Police, Abba Kyari, over a 23-count charge relating to alleged non-declaration of assets.
The ruling was delivered by James Omotosho, who held that the prosecution failed to substantiate the allegations brought before the court.
The case was instituted by the National Drug Law Enforcement Agency (NDLEA), which accused Kyari of failing to declare certain properties allegedly linked to him. The suspended police officer was arraigned alongside his two brothers, who were accused of swearing false affidavits purportedly aimed at concealing the true ownership of the properties in question.
In his judgment, Justice Omotosho stated that the prosecution did not present sufficient and credible evidence to prove that the assets cited in the charges actually belonged to Kyari. As a result, the court found that the case against the defendants could not be sustained.
The judge further explained that the ownership of landed property can only be established through verifiable means, including valid documentation and credible proof connecting a person to the property.
Given the absence of such evidence linking the assets directly to the former police officer, the court ruled that the charges lacked the legal foundation required for conviction.
Consequently, the court discharged and acquitted Kyari and the other defendants of all the counts brought against them.
