Justice Adefunmilola Demi-Ajayi of the Federal High Court sitting in Osogbo has ordered the arrest and imprisonment of Professor Mahmood Yakubu, the immediate past Chairman of the Independent National Electoral Commission (INEC), for contempt of court.
The order followed INEC’s alleged refusal to obey an earlier judgment compelling it to re-upload the names of duly recognized national and state executives of the Action Alliance (AA) on its official portal.
Delivering ruling on a motion for committal, the judge directed the Inspector-General of Police to arrest and produce Yakubu and INEC officials within seven days for imprisonment until they purge themselves of the contempt.
The court also awarded a cost of ₦100,000 against INEC and Yakubu in favour of the plaintiffs.
The ruling comes shortly after Yakubu’s tenure as INEC Chairman ended, with Mrs. May Agbamuche-Mbu taking over in acting capacity.
Legal observers say the case could test the boundaries of judicial authority over public officeholders who have left service, while political parties are watching closely for its implications on institutional compliance with court orders.
