Impeachment Backfires: Lawyers Trigger Recall Plot Against 26 Rivers Lawmakers, Petition INEC

Posted on January 9, 2026January 9, 2026 By Rextun boss No Comments on Impeachment Backfires: Lawyers Trigger Recall Plot Against 26 Rivers Lawmakers, Petition INEC

Moves to unseat 26 members of the Rivers State House of Assembly, including Speaker Martin Amaewhule, have been set in motion following the lawmakers’ impeachment notice against Governor Siminalayi Fubara.

The recall push is being driven by legislative lawyers operating under the Association of Legislative Drafting and Advocacy Practitioners (ALDRAP), who say the impeachment effort amounts to a breach of constitutional order and public trust.

Last Thursday, the lawmakers formally initiated impeachment proceedings against Governor Fubara, accusing him of gross misconduct and alleged financial impropriety. The move has since ignited political tension across the state.

In a letter addressed to the Chairman of the Independent National Electoral Commission (INEC), ALDRAP announced the commencement of recall processes against the 26 legislators who endorsed the impeachment notice.

The lawyers requested certified true copies (CTCs) of the voters’ registers for all Rivers State House of Assembly constituencies, stating that the documents are required to activate constitutional recall procedures.

Signed and dated January 8, 2026, by ALDRAP Secretary, Dr Tonye Clinton Jaja, SCN, the letter stressed that several members of the association are registered voters in the affected constituencies and are therefore legally empowered to initiate recall actions.

ALDRAP also warned INEC that it would seek judicial intervention should the Commission fail to release the requested voters’ registers within a reasonable time.

The association faulted the lawmakers for allegedly ignoring a February 2025 Supreme Court judgment which urged the Rivers Assembly and the Governor to resolve disputes amicably rather than through confrontational measures.

It further described the situation as ironic, noting that both Governor Fubara and the lawmakers involved belong to the same political party, the All Progressives Congress (APC), and should have exhausted internal party dispute-resolution mechanisms.

In a sharp legal jab, ALDRAP declared the impeachment notice “dead on arrival,” citing what it called fatal procedural defects, including the lawmakers’ reference to Governor Fubara as “madam” in their correspondence and the absence of voter authorization for the impeachment move.

According to the group, without the consent of the electorate, the lawmakers lack the moral and legal standing to pursue the removal of the governor, adding that the recall process is now firmly underway.
